Why is TCPA compliance important?

Making sure you are compliant with TCPA before starting a text campaign is crucial due to the fines that can come with malpractice(500-1500$ per text). This article is not legal advice, it is best practice to make sure you are compliant. If unsure, We recommend referring to legal counsel.

The best way to stay compliant is to practice good opt-in and opt-out procedures. We will highlight how to do this below.

OPT-IN

Firstly, you need to make sure your collection point is compliant. If you are using an online form you need to put a disclaimer below it. Here is an example,

By participating, you consent to receive text messages sent by an automatic telephone dialing system. Consent to these terms is not a condition of purchase. Message and data rates may apply. Text STOP to cancel”.

Feel free to use this copy for your own forms. Below is an example of a compliant contact collection form. This form is located in your app under "Actions" in the Contact Manager.

OPT-OUT

The next step to compliance is the opt-out. This is very similar to the "Unsubscribe" function in email marketing. For example, you should always include "Reply STOP to OPT-OUT" in your first message blast. A good strategy for your initial message is using our opt-out copy, saying who the message is from, and including a link or CTA. Something like, "Welcome to the Luxe VIP club!! get 15% off your next visit with code LUXE2020. Std. msg & data rates apply. Text STOP to unsubscribe.

If you are unsure about adding an opt-out copy to your message blast. Our text software includes it by default and we recommend leaving that option checked.
